Terms of Service
Last updated: October 26, 2026 · Effective: June 21, 2026 (section 5a: from October 9, 2026; sections 5b and 13: from October 25, 2026; section 4a: from October 26, 2026)
These Terms are a contract between you and Cyrus Cheer LLC, a Utah limited liability company ("Cyrus Cheer," "we," "us"). By using the website cyruscheer.com or the Cyrus Cheer mobile app (together, the "Service"), you agree to them. If you don't agree, don't use the Service.
The short version (for everyone, especially if you’re under 18). You need to be 13 or older (older in some countries). Be kind: no hate, harassment, or sharing anyone’s contact details, including your own. Training can hurt you, so stop if something hurts and ask an adult you trust, like a coach, athletic trainer or doctor. This app isn’t a doctor. Your membership renews until you cancel it: in your App Store settings if you bought it in the app, or with the link in your receipt email if you bought it on our website (only an adult can pay there). If something on the app worries you, report it or email us. The full rules below are the ones that count.
1. Eligibility
You must be at least 13 to use the Service, or older where the law where you live requires it. We show the minimum for your country when you sign up, and our Privacy Policy lists them. If you’re under 18, you confirm a parent or guardian knows you’re using the Service. You’re responsible for your account and for keeping your login secure.
2. The Service
Cyrus Cheer provides AI-generated cheer training programs, an exercise library, session tracking, optional add-on programs, and a public forum at cyruscheer.com/forum. We may change, add, or remove features over time.
3. Health & safety — please read (assumption of risk)
- Cyrus Cheer is a fitness and training tool, not medical advice. We are not your doctor, physical therapist, or coach.
- Consult a physician before starting any new training program, especially if you have an injury or condition, or are unsure you're healthy enough.
- Physical training carries inherent risk of injury. You participate voluntarily and assume that risk. Stop and seek medical help if you feel pain, dizziness, or distress.
- Information in the app (including injury-aware programming) is general and may not fit your specific situation. Use your judgment; a real coach or clinician overrides the app.
4. Subscriptions, billing & the founding rate
- Plans: monthly and annual memberships, sold in the app through the Apple App Store (and Google Play if we release on Android), and on our website at cyruscheer.com/join (section 4a). Current pricing is shown before you buy.
- Auto-renewal (in the app): subscriptions renew automatically at the end of each period and your store account is charged, unless you cancel at least 24 hours before the period ends. Manage or cancel in your Apple ID account settings (or Google Play, on Android) — not in the app. For memberships bought on our website, section 4a applies instead.
- Founding rate: if you subscribe at the founding price during the founding window, that rate stays the same for as long as your subscription remains continuously active. If your subscription lapses, the founding rate ends and standard pricing applies to any new subscription.
- Add-on programs (e.g. guest-athlete programs) are one-time purchases, owned after purchase, and are not included in membership unless stated.
- Refunds for purchases made in the app are handled by Apple and Google under their policies; we generally can't issue store-purchase refunds directly. Refunds for website purchases are in section 4a.
- Free preview: any free trial or preview converts to paid unless you cancel before it ends.
- If you live in the EU, the UK or another country with a right to cancel online purchases: purchases in the app are made from Apple (or Google), which handles cancellations and refunds under its own terms and your local law. Nothing in these Terms limits those rights.
4a. Buying on our website
- Who can pay. Only an adult can buy a membership on our website. If the athlete is under 18, a parent or guardian must complete the checkout themselves. By paying, you confirm you are the person paying and 18 or older, that you agree to these Terms for the purchase, and that you are responsible for the charges. If someone under 18 paid without permission, a parent or guardian can email hello@cyruscheer.com and we’ll cancel the membership and refund the most recent charge.
- Where it’s available. Website purchases are currently offered only to people in the United States. Everywhere else, you can buy in the app.
- Who processes the payment. The checkout page is run by RevenueCat and your card is charged by Stripe, our payment providers. Your membership is with Cyrus Cheer LLC. Our Privacy Policy explains what they receive.
- What you’re charged, and when. The price, in US dollars, is shown on the checkout page before you pay. You’re charged when you buy, and then automatically at the start of each new month or year at the same price until you cancel. If we ever change the price of your plan, we’ll email you 7 to 30 days before the new price applies, with the new price, the date it starts and how to cancel. A founding rate doesn’t change while your subscription stays continuously active (section 4).
- How to cancel. Cancel anytime online with the “manage subscription” link in your receipt email, or email hello@cyruscheer.com from the address you paid with and we’ll cancel it within one business day. Cancelling stops the next charge. You keep your membership until the end of the period you’ve paid for. A website membership doesn’t appear in your iPhone or Google Play subscription settings, and cancelling there won’t cancel it.
- Refunds. We don’t refund the unused part of a month or year after you cancel. If a charge was a mistake — you were charged twice, charged after you cancelled, or something went wrong on our side — email hello@cyruscheer.com and we’ll refund it. Nothing here limits a refund your local law gives you.
- One membership is enough. A membership bought on the website and one bought in the app are separate subscriptions. We stop a second purchase when we can see you’re already a member, but if you end up paying twice, email us and we’ll cancel the website one and refund its charges for the time you were paying twice.
- Tips. You can leave an optional one-time tip on our website. A tip is a voluntary payment to Cyrus Cheer LLC: it doesn’t buy a membership, features or anything else, it isn’t a charitable or tax-deductible donation, and only an adult can pay it. Tips aren’t refunded unless one was charged by mistake — email hello@cyruscheer.com and we’ll refund it. Tips show on our public “Latest tips” list as Anonymous unless you choose a name to show. Names must follow section 5, and we can hide any name or tip from the list.
- If a payment fails. If a renewal can’t be charged, we or our payment provider may try again, and your membership may be paused while we do. If it still can’t be collected, your membership ends, and a founding rate ends with it (section 4).
5. Acceptable use
Don't share your account, copy or redistribute program content or videos, reverse-engineer the app, scrape it, or use it to harm others. Content and programs are licensed to you for personal, non-commercial training use only.
Zero tolerance for objectionable content and abusive behaviour. The app lets you choose a handle and a display name, and lets athletes you have added as friends see them alongside your training counts. You may not choose a handle or display name — or behave toward another athlete — in a way that is offensive, harassing, hateful, sexual, threatening, or that impersonates somebody else. Many of the people using this app are minors, and we treat that seriously.
How to report it. You can report an athlete straight from the Roster screen in the app — reporting also blocks them immediately, so you do not have to wait for us — or email us at hello@cyruscheer.com. On the forum, use Report on the post or reply. We review every report we receive and aim to respond within two business days. Where a report is justified we remove the handle, display name or other content, and we may suspend or remove the account; serious or repeated breaches mean removal. You can also remove any athlete from your roster yourself, at any time, from the Roster screen.
5a. Your posts on the forum
- The rules. If you post, reply, vote or report on the forum, you agree to follow our Forum Guidelines, which are part of these Terms. You must be 13 or older and have a Cyrus Cheer account to post.
- Your posts are public. Anyone can read the forum, with or without an account. Your @handle is shown with what you write. Don't post personal or contact information about yourself or anyone else.
- You own what you write. You keep ownership of your posts. You give Cyrus Cheer LLC a non-exclusive, worldwide, royalty-free licence to host, store, copy, display and distribute your posts on the Service, for as long as they are on the Service, so that we can run the forum. The licence ends when your post is deleted, except for copies we keep as our Privacy Policy describes or as the law requires.
- We won't use your posts in our marketing without asking. We will not quote your posts or your @handle in advertising or promotion unless you say yes first — and, if you are under 18, a parent or guardian also says yes.
- Ideas and requests. The forum exists so you can tell us what to build. If you suggest a skill, a feature or a fix, we may build it, and we may build something similar that we were already working on. Suggesting something does not make it yours or entitle you to payment, and a request getting votes is not a promise that we will build it.
- You are responsible for what you post. Only post things you have the right to share. Posts are the views of the athletes who wrote them, not of Cyrus Cheer. Replies labelled “Cyrus Cheer team” are ours.
- Not medical advice. Nothing on the forum is medical advice, including replies from the Cyrus Cheer team. Section 3 applies: if something hurts, stop and talk to a doctor, athletic trainer or coach.
- Moderation. We can refuse, hide or remove any post, and suspend or remove any account, that breaks these Terms or the Forum Guidelines. Our server automatically refuses posts with links, contact details or offensive language, and a post reported by three different athletes is held until we review it. We don't review every post before it appears, so please report anything that breaks the rules.
- Copyright. If you believe something on the forum infringes your copyright, email hello@cyruscheer.com with the post and the work you believe it copies.
5b. Reporting illegal content, and what we tell you when we act
Anyone can report, with or without an account. If you think something on the Service is illegal, email report@cyruscheer.com with: (1) why you believe it’s illegal, (2) the exact link to the post or the @handle, (3) your name and email address (unless the report is about child sexual abuse material, in which case you don’t have to identify yourself), and (4) a statement that you believe your report is accurate and complete. We confirm we’ve received it, decide on it promptly and carefully, and tell you what we decided.
How moderation works. Our server automatically refuses posts that contain links, contact details or offensive language. A post that three different athletes report is held out of view until a person on our team reviews it. Staff decide every removal, hold that stays in place, and account suspension. We don’t use AI to make these decisions.
If we act on your content or account, we email you at your account address with: what we did (removed, hidden, or account suspended or removed, and for how long); the facts we relied on, including whether it came from a report or our own review; which rule it broke (these Terms or the Forum Guidelines) or, if we think it’s illegal, the law involved; whether any automated filter was part of it; and how to challenge it. To challenge a decision, reply to that email within six months. A different person from the one who made the original decision reviews it where we can, and we tell you the outcome. You can also go to court, and in the EU you may be able to use a certified out-of-court dispute settlement body.
We don’t send this email when a post was refused before it was ever published (you see the reason on screen), or if telling you would put someone in danger or interfere with a criminal investigation.
For authorities: our single point of contact under the EU Digital Services Act is dsa@cyruscheer.com, in English. Our legal representative in the EU is being appointed; until we publish their details here, use that address.
If someone’s life or safety is at risk from something posted on the Service, we report it to the police where we’re required to.
6. Intellectual property
The app, brand, exercise library, videos, and program content are owned by Cyrus Cheer or its licensors (including guest athletes). You get a limited, personal, non-transferable license to use them while your account is active.
7. Guest-athlete programs
Add-on programs created with guest athletes are licensed to you for personal use. Guest athletes' names and likenesses are used under agreement; you may not reuse them.
8. Disclaimers & limitation of liability
- The Service is provided "as is" without warranties of any kind.
- We don't guarantee specific results (more height, new skills, etc.).
- To the maximum extent allowed by law, Cyrus Cheer LLC is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the prior 12 months.
- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law where you live doesn’t let us limit or exclude. If you’re a consumer, the limits in this section apply only as far as your local law allows.
9. Termination
You can stop using the Service anytime and cancel via your app store or, for a membership bought on our website, as section 4a describes. We may suspend or end accounts that violate these Terms.
10. Changes to these Terms
We may update these Terms; we'll post the new version and update the "Last updated" date, and notify you of material changes. Continued use means you accept the changes.
11. Governing law and where disputes are heard
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. If you’re a consumer living outside the United States, this choice of law doesn’t take away the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts of that country. If a dispute comes up, please contact us first at hello@cyruscheer.com so we can try to sort it out informally.
